These Terms govern access to and use of the photosnp event-photography platform provided by House Of Green Media LLC (“photosnp,” “we,” “us”). By creating an account or using the service you agree to these Terms. If you use the service on behalf of an organization, you represent that you are authorized to bind it.
Accounts are provisioned by photosnp (self-service sign-up may not be available). You are responsible for your credentials and all activity under your account, and must provide accurate information. You must be at least 18 and legally able to contract.
You are the controller of your Event Data. You are responsible for having all necessary rights and permissions for the photos you capture and process, and for providing any legally required notices and obtaining any legally required consent from attendees — including for pattern recognition / biometric processing (e.g. under the Illinois Biometric Information Privacy Act (BIPA), GDPR, CCPA, or other applicable laws) and for capturing contact information.
You agree to use the service in compliance with all applicable laws, to obtain consent where required for minors, and not to use pattern recognition or lead capture in any unlawful or deceptive way. photosnp provides tools (guest opt-in, consent text, and self-service deletion) to help, but you remain responsible for lawful use at your events.
You will not: upload content you lack rights to; use the service to harass, harm, or unlawfully surveil anyone; attempt to access other customers’ data; probe or disrupt the service; or resell/rebrand it except as expressly permitted by your plan.
You retain ownership of your Event Data. You grant photosnp a limited license to host, process, and display it solely to provide the service (including generating thumbnails, pattern matches, QR codes, and guest galleries). photosnp owns the platform, software, and its trademarks.
Guests may view, download, and share photos made available to them, for personal, non-commercial use, and may use or decline pattern matching. Guests can delete their gallery and biometric data at any time. Photos may be subject to the organizer’s own terms.
The service relies on third parties (e.g. cloud storage, payment processing, hosting). Their availability and terms may affect the service; we are not responsible for their acts or omissions.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT PATTERN MATCHING IS ERROR-FREE OR THAT THE SERVICE WILL BE UNINTERRUPTED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHOTOSNP WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
You will defend and indemnify photosnp against claims arising from your Event Data, your events, your use of the service, or your failure to obtain required consents (including biometric/BIPA claims).
You may stop using the service at any time. We may suspend or terminate for breach, non-payment, or legal reasons. On termination, your right to use the service ends; we may delete Event Data after a reasonable period.
These Terms are governed by the laws of Florida, USA, without regard to conflict rules. We may update these Terms; material changes will be noticed, and continued use constitutes acceptance.
